New Vulnerable Sector Screening:
Bill C-7 proclaimed August 1, 2000 amends the Criminal Records Act to
permit the flagging of pardoned sex offenders. The amendments provide
for an agency to identify key positions where employees or volunteers
will be working with vulnerable persons. Given this, the organization
may ask the applicant to consent to a specific search that will verify
his or her declaration that they have not been convicted of a sexual
offence for which a pardon has been granted. Specific protocol must be
followed for searching and releasing this information.
It is important that the consents are complete, including whether or
not the applicant will be responsible for vulnerable persons.
Vulnerable person means a person who because of their age,
disability or other circumstances, whether temporary or permanent are:
- in a position of dependence on others, or
- otherwise at a greater risk than the general population
of being harmed by a person in a position of authority or trust.
The vulnerable sector screening will not automatically be conducted
unless it is clearly indicated on the consent. Agencies should be aware
of this. To assist agencies, our Police Information Search Letters will
clearly state whether applicant consented to the vulnerable sector
search.
